Terms of Service for Proofly on iOS
These Terms of Service ("Terms") govern your use of the Proofly iOS app, its Safari extension, Proofly accounts, cloud synchronization, research history, AI-assisted features, and Proofly Pro subscriptions. By creating an account or using Proofly, you agree to these Terms together with our Privacy Policy and End User License Agreement. Please read them.
1. Who can use Proofly
You must be old enough to form a legally binding contract in your country or region. If you are under the age of majority where you live, a parent or legal guardian must review and approve your use of Proofly. By using Proofly you confirm that you meet this eligibility requirement.
2. What Proofly provides
Proofly is a personal shopping research assistant for iPhone and iPad. When you request a product check, the Safari extension reads the product page you are viewing and, using your selected research sources, collects relevant publicly visible posts and comments from those sources to organize into summaries, sentiment signals, repeated buyer praise, repeated concerns, and source references.
Proofly provides informational research only. It is not a guarantee, professional recommendation, product safety certification, endorsement, or substitute for your own judgment. Public discussions may be incomplete, inaccurate, outdated, manipulated, region-specific, or unrelated to the product you are researching. Always verify seller terms, warranties, safety notices, and return policies through authoritative sources before purchasing.
3. Your Proofly account
Most features require a Proofly account so the app and Safari extension can synchronize settings, subscription entitlement, usage counts, and research history. You must provide accurate registration information and keep it current. You are responsible for keeping your login credentials and device secure.
If you believe your account has been accessed without your authorization, contact support@proofly.im immediately.
You may delete your account at any time from Account → Delete account in the app. Account deletion removes your Proofly cloud data as described in the Privacy Policy. It does not automatically cancel an Apple subscription; subscriptions must be cancelled separately through Apple.
4. Proofly Pro — Apple In-App Subscriptions
Proofly may offer auto-renewable subscriptions (currently Weekly and Yearly Proofly Pro) through Apple's In-App Purchase system. All subscription management, billing, and payment processing is handled by Apple under Apple's applicable terms.
- Available plans, current prices, billing period, included features, monthly usage allowance, and any trial or introductory offer terms are displayed in the Proofly paywall before you purchase.
- Payment is charged to your Apple Account when you confirm the purchase.
- Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period.
- Your Apple Account may be charged for renewal within 24 hours before the current period ends.
- You can manage or cancel your subscription from Proofly's Plan tab → Manage, or from iOS Settings → [your name] → Subscriptions.
- Restore Purchases is available on the paywall and Plan screens for eligible purchases tied to your Apple Account.
- Trials and promotional offers, when available, are governed by terms shown at purchase. An unused trial period may be forfeited when a paid subscription is purchased, where Apple's policies permit.
- Deleting Proofly or deleting your Proofly account does not cancel an active Apple subscription. Billing continues until the subscription is cancelled through Apple.
- Refunds are governed by Apple's refund policies. Proofly cannot directly issue App Store refunds. You may request a refund from Apple at reportaproblem.apple.com.
5. Usage allowances and fair access
Proofly Pro plans include a monthly product-check allowance. The current allowance and your remaining usage are displayed in the app and extension. A check may count against your allowance when you start a new research request, even if some selected sources return no relevant public results.
We may use reasonable safeguards against fraud, automation abuse, account sharing, or attempts to circumvent plan enforcement. Accounts found in violation may have usage restricted or be suspended.
We may adjust future plan allowances, features, or pricing with reasonable notice.
6. Safari access, research sources, and how collection works
Proofly's Safari extension requires website access that you grant and control in iOS Settings → Safari → Extensions → Proofly. You can set access to "Ask," "Allow for One Day," or "Always Allow," and revoke it at any time.
When you activate a product check, the extension may temporarily open background Safari tabs for your selected research sources. Those tabs are closed as soon as collection is complete. Proofly reads only publicly visible content — it does not access private messages, account settings, or content that requires your social media credentials to view.
You are responsible for granting only the level of access you are comfortable with, and for complying with the applicable terms of service of any source websites you use with Proofly.
Proofly is not affiliated with or endorsed by any retailer, Reddit, YouTube, TikTok, Instagram, X, Facebook, or other third-party source unless explicitly stated. Source availability may change due to website updates, regional restrictions, authentication changes, or third-party policy changes. Proofly does not guarantee results from any particular source.
7. Shared research cache
To provide faster results and reduce unnecessary repeat processing, Proofly uses a shared, anonymized research cache stored in Firebase Firestore. When a research job completes, a compact, de-identified summary of the results may be cached under a normalized product key for up to 90 days. A subsequent user researching the same product may receive cached results instead of triggering a new research run.
No personal account information is associated with cached results. You can force a fresh research run from the app at any time. Full details are in the Privacy Policy, Section 4.
8. AI-assisted features
Proofly uses OpenAI (via our secure Firebase Cloud Functions relay) to provide AI-assisted product summaries, decision insights, sentiment analysis, and natural-language Q&A about research results.
When AI features are used, the product name, product URL, research query, and relevant public post excerpts are sent to OpenAI. Your Proofly account information, social media credentials, and private communications are never sent to OpenAI. Full details are in the Privacy Policy, Section 6.
AI output may contain errors, omissions, or outdated information. Do not rely on Proofly for medical, legal, financial, product-safety, emergency, or other professional decisions. AI-assisted results do not constitute professional advice of any kind.
You may disable AI features in Settings if you do not wish to use them.
9. Public content and third-party intellectual property
Posts, comments, captions, usernames, channel names, and other content collected from research sources remain the intellectual property of their respective owners and platforms. Proofly uses relevant publicly visible material only to provide you with research context and source references in your personal research history. Results are shown only to you and are not republished, sold, or shared with other parties except as described in the shared research cache section.
Do not use Proofly to access private communications, confidential content, restricted systems, or any content you are not personally authorized to view.
10. Acceptable use
You agree not to use Proofly to:
- Engage in unlawful, harmful, deceptive, abusive, infringing, harassing, or privacy-invasive activities.
- Collect private messages, passwords, sensitive personal data, confidential business information, or any content you are not authorized to access.
- Profile individuals, facilitate discrimination, stalk, or republish personal information without a lawful basis.
- Bypass authentication systems, subscription checks, usage allowances, security controls, or source restrictions.
- Reverse engineer, decompile, copy, resell, sublicense, redistribute, or commercially exploit Proofly except where expressly permitted by applicable law.
- Overload, interfere with, damage, or introduce malicious code into Proofly, Apple services, or third-party websites.
- Create false or misleading research results, or use AI output to deceive others.
11. Your content and feedback
You retain all rights you hold in information you provide to Proofly (such as your profile information and settings). You grant Proofly a limited, non-exclusive right to store, process, transmit, and display that information solely as necessary to operate, secure, support, and improve the service. If you submit feedback or feature suggestions, you allow us to use them without obligation to you, provided we do not publicly identify you without your permission.
12. Proofly's intellectual property
Proofly's app, Safari extension, code, design, branding, logos, trade names, documentation, and original service content are owned by Proofly or its licensors and are protected by applicable intellectual property law. These Terms do not transfer any ownership interest to you. Your license to use the app is governed by the End User License Agreement.
13. Service changes and availability
We may update the app, improve or remove features, change supported research sources, adjust future plan allowances, or discontinue part or all of the service. We will provide reasonable advance notice of material changes where required. Third-party services, research source websites, AI providers, and internet connectivity may be unavailable, slow, or changed without notice. Proofly does not guarantee uninterrupted service or complete research results.
14. Suspension and termination
You may stop using Proofly or delete your account at any time. We may restrict, suspend, or terminate your access when reasonably necessary to address a Terms violation, security risk, fraud, legal requirement, harm to users or third parties, or service discontinuation. We will provide reasonable notice where legally required and practicable. Terms provisions that by their nature should survive termination will survive.
15. Disclaimers
To the maximum extent permitted by applicable law, Proofly and its services are provided "as is" and "as available" without warranties of any kind, including warranties of accuracy, completeness, availability, merchantability, fitness for a particular purpose, or non-infringement. Nothing in these Terms excludes statutory warranties or rights that cannot legally be excluded or limited in your jurisdiction.
16. Limitation of liability
To the maximum extent permitted by applicable law, Proofly and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, business interruption, losses caused by third-party products, sellers, source websites, public content, AI output, or purchasing decisions. Any limitation applies only to the extent permitted by applicable consumer protection law in your jurisdiction.
17. Governing terms
These Terms are governed by applicable law. You are not deprived of any mandatory consumer protections provided by the law of your country or region. If any provision of these Terms is found unenforceable, the remaining provisions continue in full force. A failure to enforce any provision is not a waiver of our right to enforce it in the future.
